These Terms of Use (“Terms”) govern access to and use of the WhoX VPN services and related products (“Service”), including the website whox.is (“Website”), mobile/desktop applications (“Apps”) and browser extensions (“Extensions”). The terms “WhoX”, “we”, “us”, “our” refer to Sam digital solutions FZE, a company registered in a UAE free zone. By using the Service you confirm that you have read and agree to these Terms and to our Privacy Policy.
These Terms are a legally binding agreement between you (“User”) and WhoX. They apply to your use of the Website, Apps, Extensions and all VPN service features. If you do not agree with the Terms, do not use the Service.
We may update the Terms. If you continue to use the Service after changes take effect, this constitutes your acceptance of the updated Terms.
The Service is intended for users aged 18 or older. By using the Service, you represent that you are legally capable of entering into a contract in your jurisdiction and that your use complies with local law.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. If you suspect unauthorized access, contact us immediately so we can suspend access and issue new credentials.
We grant you a limited, revocable, non‑transferable, non‑exclusive license to use the Website, Apps and Extensions solely for lawful purposes and in accordance with these Terms. Reverse engineering, modification, decompilation, or circumvention of technical limitations is not permitted unless expressly allowed by applicable law.
Intellectual Property. All materials and elements of the Service (texts, graphics, logos, software code, etc.) are protected by intellectual property rights and belong to WhoX or its rights holders. Use of such materials is allowed only to the extent expressly permitted by these Terms.
You must not use the Service for actions that violate the law or third‑party rights, including:
To protect the Service from abuse, we may apply technical and organizational measures (including blocking and account suspension) where there are indications of violations, third‑party complaints or security risks.
The WhoX VPN Service is not offered and must not be used in the following jurisdictions: Russia, United Arab Emirates, Qatar, Iran, China. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction. We may restrict access to the Service or to certain features to comply with law and with the rules of app distribution platforms.
Payments may be processed via Apple App Store /Google Play, Stripe (bank cards) andCryptomus (cryptocurrencies). Such providers act as independent controllers under their own policies and terms. We do not control their platforms, policies or availability.
The Website may contain links to external resources. We are not responsible for their content, accuracy, availability or the consequences of their use.
Billing, auto‑renewal and refund terms are established by the rules of the respective platforms (Apple/Google) or described in ourSubscription Terms andRefund Policy (if applicable). We do not store full card numbers and rely on secure payment providers. Fees and exchange rates may depend on the provider and the network.
The Service is provided “as is” and “as available”. We do not warrant uninterrupted operation, absence of errors, fitness for your particular purposes, or compatibility with your equipment or software.
No SLA / QoS. No guarantees of throughput, speed or availability; traffic shaping may apply;no SLA is provided.
Free features. With respect to the Service’s free features, our liability is excluded to the fullest extent permitted by applicable law.
Paid features. Our aggregate liability for all claims related to paid services is limited to thetotal amount actually paid by you to us for access to the Service’s paid features. Nothing in the Terms limits liability for willful misconduct or fraud to the extent such limitation is prohibited by law.
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, punitive, special, consequential damages, or for lost profits or data, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless WhoX, its affiliates, officers, employees and partners from any claims, demands, losses, expenses (including reasonable attorneys’ fees) arising from your violation of the Terms, the law, or third‑party rights.
We are not liable for failure or improper performance caused by circumstances beyond our reasonable control, including without limitation: failures of power and network infrastructure; acts/omissions of telecom operators, data centers, cloud providers, CDN and DNS providers; payment providers and payment systems; app stores (Apple/Google); registrars/hosting providers; public blockchain networks; as well as DDoS attacks, large‑scale cyber incidents, regulatory restrictions and blocks, natural disasters, and other force‑majeure‑type events. During such circumstances, performance is suspended without any liability on our part.
We may suspend or terminate your access to the Service (including removal or disabling of your account) without prior notice in case of violations of the Terms, security risks or abuse. Refunds are governed by the policies referenced in section 8.
We may modify, suspend or discontinue any Service features (including beta features) at any time,without prior notice, liability or compensation.
We may amend the Terms and publish an updated version with a new “Last updated” date. For material changes, we may also provide additional notice on the Website or in the Apps. Continued use constitutes acceptance of the updates.
These Terms are governed by the law of the relevant UAE free zone (without regard to conflict‑of‑laws rules), unless mandatory provisions prescribe otherwise. Disputes shall be resolved by the competent courts of that jurisdiction.
You confirm compliance with applicable export control rules, sanctions regimes and import/export restrictions. You are not the subject of blocking sanctions and will not use the Service to circumvent them.
Assignment. We may assign this agreement in whole or in part, as well as our rights and obligations hereunder in connection with a reorganization, merger, sale of assets, or by operation of law. You may not transfer your rights or obligations without our prior written consent.
Survival. Upon termination of access to the Service, the provisions on no warranties, limitation of liability, governing law and jurisdiction, indemnity, force majeure, assignment and other provisions that by their nature should survive will continue to apply.
Entire Agreement. These Terms constitute the entire agreement between you and WhoX regarding the subject matter and supersede all prior arrangements.
Headings. Section headings are for convenience only and do not affect interpretation.
No Third‑Party Beneficiaries. These Terms do not confer any rights or remedies upon any third party.
Notifications. We may deliver legally significant notices by posting on the Website, in the Apps and/or by email to the address associated with your account. Electronic notices are deemed properly given.
Severability. If any provision is held invalid, the remaining provisions remain in force.
No waiver. Our failure to enforce any right shall not be deemed a waiver of that right.
Language Priority. In case of discrepancies between translations, the English version of the Terms shall prevail.
